Platinum Graphic Design’s Terms and Conditions

Welcome to Platinum Graphic Design. These terms and conditions outline the rules and regulations for the use of our website and the sale of our graphic design services and digital goods. By accessing this website or purchasing our services, you accept these terms in full.

  1. Scope of Services

Platinum Graphic Design provides digital graphic design services, including logo design, branding, website graphics, and other custom designs. All services will be outlined in a written or electronic contract, which specifies the deliverables, timelines, and pricing.

  1. Payment Terms
  • Payment Schedule: A 100% payment is required upfront to begin work.
  • Payment Methods: We accept payments via Credit Card and Bank Transfer
  1. Ownership and Usage Rights
  • Design Ownership: Ownership of the final design is transferred to the client only after full payment has been made. Until then, all designs remain the property of Platinum Graphic Design.
  • License: Once payment is completed, the client is granted a non-exclusive, worldwide license to use the design for the purposes agreed upon. Any other use (e.g., sublicensing, resale) requires additional permissions and fees.
  • Portfolio Use: Platinum Graphic Design reserves the right to display the completed project as part of its portfolio, unless otherwise agreed upon in writing.
  1. Copyright and Third-Party Materials
  • Original Work: All designs created by Platinum Graphic Design are original and owned by us until transferred to the client. However, we are not responsible for any copyright infringement caused by client-provided content (e.g., logos, images, text).
  • Third-Party Assets: If third-party assets (e.g., stock images, fonts) are used, their licenses will be passed on to the client with limitations on their use as specified by the provider.
  1. Revisions and Approval Process
  • Revisions: The project includes up to 8 revisions, as specified in the contract. Any additional revisions will incur an extra fee of RM100 per revision.
  • Approval: Clients are responsible for reviewing all work for accuracy and completeness during the revision stage. Once approved, the project is considered complete, and any further changes will be treated as a new project.
  1. Delivery Timeline
  • Turnaround Time: Our estimated turnaround times are provided during the initial consultation and are dependent on the scope of the project. Delays caused by the client (e.g., failure to provide feedback or required assets) may result in extended timelines.
  • Delivery Method: All files will be delivered digitally via email or through a secure download link in the agreed formats (e.g., PNG, JPG, PDF, or vector formats such as AI or EPS). Video files will be delivered digitally via email or through a secure download link in the agreed formats (e.g.,MP4 & MOV)
  1. Refunds and Cancellations
  • Non-Refundable Deposit: The payment is non-refundable once work has begun on the project.
  • Cancellations: If the client cancels the project after work has started, they are liable for payment proportional to the work completed.
  • Refund Policy for Digital Goods: Due to the nature of digital goods, no refunds will be issued once final files are delivered.
  1. Limitation of Liability

Platinum Graphic Design is not liable for any damages arising from the use or misuse of our designs. This includes, but is not limited to, any indirect, incidental, or consequential damages.

  1. Client Responsibilities

Clients must provide all necessary information, materials, and feedback promptly to ensure the project stays on schedule. Any delays in this regard may lead to project postponements or additional fees.

  1. Confidentiality

We respect the confidentiality of all our clients. Any confidential information shared with us will only be used for the purpose of completing the project and will not be disclosed to third parties without the client’s permission.

  1. Termination

Platinum Graphic Design reserves the right to terminate any project if:

  • The client fails to meet their obligations (e.g., payment, communication).
  • The client engages in any behavior deemed abusive or inappropriate. In such cases, all work completed up to that point will be billed, and any outstanding balance will be due immediately.
  1. Force Majeure

Platinum Graphic Design will not be held responsible for any delays or failure to complete a project due to circumstances beyond our control, such as natural disasters, technical failures, or unforeseen emergencies.

  1. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising out of these terms will be subject to the exclusive jurisdiction of the courts in Malaysia.

  1. Changes to Terms

Platinum Graphic Design reserves the right to amend or update these terms at any time. Clients will be notified of significant changes, and continued use of our services constitutes acceptance of the updated terms.
